The Court of Appeal, situated in Lagos State, has affirmed Siminalayi Fubara of the Peoples Democratic Party (PDP) as the Governor of Rivers State.
The decision follows the dismissal of the petition filed by Patrick Tonye-Cole, the governorship candidate of the All Progressives Congress (APC) in Rivers State.
Tonye-Cole had contested the victory of Fubara and challenged his declaration as the winner of the governorship election held in March 2023 by the Independent National Electoral Commission (INEC).
Present in the courtroom on Tuesday, the APC candidate sought the court’s direction to declare him the winner of the election.
In October, the Rivers State Governorship Election Petition Tribunal had previously dismissed Cole’s petition, citing the withdrawal of the petition by the APC, the party that sponsored him. Unhappy with the Tribunal’s ruling, Tonye-Cole took the case to the Court of Appeal.
On Tuesday, the Court of Appeal affirmed the Tribunal’s decision, thereby upholding Fubara’s electoral victory in the March governorship election.
